Injuries And Accidents At Concerts And Music Venues In San Diego

Client Testimonials

Live music of any form is always an enjoyable venture. Whether you go for classical, jazz, classic rock, or more modern music, there's nothing like listening to your favorite band, orchestra, or musician in person. Most concerts don't make the news. But when they do, there are usually injuries involved. The first concert accident occurred at a Cincinnati arena in 1979 at concert by The Who. Eleven concertgoers were trampled and died by asphyxiation while trying to get into the venue with hundreds of others.

The latest concert accident happened in November of 2021 during the Travis Scott concert in Houston, Texas. Ten people, aged 9 through 27 years old, died from compression asphyxiation after crowds surged the stage during the concert. More than 300 people were also injured. Police and event security quickly lost control of the situation. People were trapped in by barricades and had no way to escape. The concert continued for more than 30 minutes until police and security finally stopped it to help the injured.

Accidents like these can happen at any time during any concert and for any reason. A fire or other emergency in the venue can cause immediate panic. Accidents can occur in a small club to a large arena. If the patrons don't know where the emergency exits are, it can lead to a crush situation where people are trampled and die from asphyxiation.

Premises Liability

Injuries and accidents on private or public property are known as premises liability cases. Owners, and occupants have a duty of care to maintain their property in a reasonably safe condition. They are also required to warn guests and visitors of any potential dangers even if they are open and obvious.

The duty of care requires people who own, control, or possess property to exercise this duty of care to:

  • Inspect their property regularly for hazardous conditions
  • Maintain their property and repair any potentially hazardous conditions or
  • Give adequate warning of the hazardous or dangerous conditions

A property owner or occupier who fails to keep their property in a reasonably safe condition can be held liable for injuries sustained on the property because of their negligence. Someone who is injured on the property may be able to file a personal injury lawsuit against the property owner for damages they suffered from the negligent and hazardous conditions.

In addition to crowd rushing situations, other accidents can happen in a venue including:

  • Mezzanines, balconies, and other off-the-floor structures can collapse under the weight of too many people
  • Improperly lit stairs that are a trip hazard when patrons can't see the difference between the floor or a bottom step or make it difficult to see where they’re going
  • Spills on the dance floor or other floor area that cause slip and falls
  • Missing or broken handrails in stairwells
  • Insufficient security, leading to assaults and other crimes
  • Exposed hazardous areas with no barricades or other protection, such as a water puddle or broken sidewalk

These are just some of the ways accidents can occur where you’d planned on an enjoyable excursion.

Liability At Concert And Music Venues

No one should suffer injuries at a concert, but it does happen. The venue can be held accountable under premises liability if they failed to keep the property in a safe condition and it led to your injuries.

But depending on the circumstances, other parties may be liable in addition to or instead of the venue owner or occupier. For instance, the concert promoter or the local onsite venue security may have been negligent in preventing your injuries.

The musical act can also be held liable if they were responsible for the accident. Travis Scott has a history of encouraging concertgoers to bypass security and rush the stage, and was charged twice in prior incidents. Live Nation Entertainment, Scott’s concert promoter, also has a history of safety violations, including understaffed security teams.

If reckless or dangerous behavior by another concertgoer is responsible, they can also be held liable and accountable for your injuries. The addition of alcohol and/or drugs to an already volatile situation increases the potential for serious injuries. Both situations can lead to a personal injury lawsuit against the responsible individual.

Accidents such as these at concert and music venues can lead to injuries such as:

  • Broken bones
  • Spinal injuries
  • Head injuries, including traumatic brain injuries
  • Slip, trip, and fall injuries
  • Electric shock
  • Other permanent, disabling injuries
  • Food poisoning from vendors that don't follow safe food handling practices

The injuries are generally caused by negligence on the part of someone who knew or should have known about the problem that caused the accident but failed to take corrective action.

Claim For Premises Liability

To bring a successful claim for premises liability in California, you must show that the property owner or other responsible party failed to exercise reasonable care, and this negligence caused the accident that resulted in your injuries.

Your compensation can include:

  • Medical expenses
  • Lost wages
  • Lost earning capacity and future wages
  • Property damage
  • Pain and suffering
  • Other related expenses

Sometimes the outcome of a concert venue case is that someone dies. The surviving family members may be able to bring a claim of wrongful death against the responsible party. The claim can include compensation for:

  • Final medical expenses related to the accident
  • Funeral and burial expenses
  • Lost future wages the deceased would have earned
  • Loss of support and companionship from the deceased

Working with a San Diego premises liability attorney for concert and music venues will ensure that your case will be handled correctly and that you’ll be able to collect the maximum compensation for your injuries.
